what is the best route, financially, for a divorce settlement?

writing my own divorce papers, to save $ in lawyer fees. so i can’t consult one on this subject, yet (had 1 mtg, more req. retainer) . i’d like answers based on knowledge/exp. no judgemental notes, plz. thanx. in dividing assets: he gets the house, a rental we own (split proceeds for both 50/50 if sold) , his car, asking for no retirement benefits from him (i don’t work, stay at home mom to 3 & student). i’m moving to an apt., asking for state reg. child support, $500 alimony, (expires in 3 yrs to help me finish school, get the kids in school, get a job). taking an auto loan off his hands. my thng: i get 2 annuity lumpsum pymnts in 5 & 7 yrs of a decent $ amt (from a childhood accident). @ consult mtg atty told me he is entitled to part. if i’m not asking for retirement (military…eligible?), houses & by that time not getting ali., do i have to legally share that $ w/ him? what if i am remarried or he is? i got the 1st setlement when i was 13, these are the last 2 pymnts.

My husband was injured in an auto accident and the settlement was set up in a structured annuity for a 30 year period. # years ago he died, with 25 years left on the annuity, which has passed into his estate and I get the monthly payments. My question is, I have fallen on bad times, fell behind on property taxes and other things and close to loosing my home. Can a structured settlement annuity be terminated and the balance paid?

I had a very strong sexual harassment case from a former employer (I was fired for squeeling).. and they know they are in trouble, so they agreed to a mediation. Once we have reached a number for the settlement in this mediation, how long does the company have to pay me my cut? Or if by chance (i dont think it will happen), if they get a structured settlement, how long do they have to start paying it?

My son was injured a few years ago, Me and his father had joint custody of him then. His father took care of the insurance settlement without my knowledge. I know it is structured and he is to receive his first payment at the age 18. I now have full custody of my son, and his father has been out of the picture for 3 years. I don’t know where to begin to look for information on the structured settlement. I don’t even know the amount, I do know they appeared in court but not sure what court. How do I find out any information? My son will be 18 in a few moths and I really need to find out as much info as I can for him…..Thanks

i’m going to be 18 in a few days and i have a structured settlement that i’m not supposed to be getting until august of 2009. problem is, my father is unemployed and i have a car that is barely running. i live pretty far out in the country and there’s no public transit, so there’s really no way of getting to and from a job without a reliable vehicle. if i go to a bank and offer the paperwork on my structured settlement as collateral or something, what are my chances of getting a loan even though i’m unemployed or can i even get one at all?

I have made the choice to sell my structured settlement. (Keep all negative comments to yourself please, I just need an answer to this question and that is all.) My insurance company, Symetra Financial offered me a lump sum, which I decided to take instead of my monthly payments, I am doing this so that I can purchase a home outright as I am tired of renting, and so that I can go to school without student loans, and so that I can purchase a vehicle outright, among other things. My case has to go to Missouri state court, and the state of Missouri has to approve the sale. I am wondering if anyone knows what the likely hood of them approving or denying the sale is? How long it takes, and general information on the sale of a structured settlement in Missouri. Thanks.

Once an order is made on a settlement ~ can the settlement be done in structured payments without first letting the court know that is the intent?
Is there anything the attorney can do? What if we don’t want a structured settlement?
None of this was mentioned in the court ~ the total payouts were listed and signed off and we were told the check would arrive in 3 to 6 weeks. We received 25% ~ I did some math and it looks as though they are going to pay this out over the course of two years.
3rd Party Managed ~ all medical bills paid directly to providers ~ call into the attorney now ~ call to 3rd party ~ they intend to pay out future 182 weeks ~ as WEEKLY payments ~ settlement was offered as lump sum ~ not future ~ but thank you for the reply.
On a side note ~ you can’t even sell this type of settlement in the state of NJ.

I’ve seen the commercials on TV for companies like Peachtree. My fiance is receiving structured settlement payments from an accident he was in a few years back. His next scheduled payment is in 2012, and then again in 2017. He was interested in getting an advancement on these payments in hopes of putting a down payment on a house for us, since we’re getting married in 2011.
I’m unsure because the papers he has from the settlement proposal have his signature, stating he will not request premature payments. Is this how all settlements are? And the companies know how to get around that? Or is there nothing he can do? – Apparently the money is already in an account, so it’s not as if the settlement company has to try and get money from the insurance company. Does this make a difference?

He made a full recovery. The money was issued to him as a settlement because of someone else’s negligence. It wasn’t money set in place for bills from his insurance company.
He chose how his payments would be set up, and when he would get the money. He split it up, but at the time, he wasn’t even thinking about settling down or having a home, so now that this popped up, he’s all for getting the advancement. He knows he’ll only get about half of what he’s supposed to get in the long run, but with the inflation rates, etc, he doesn’t really mind. And we’d like to try and qualify for the new home buyer’s tax credit.

I have a structured settlement that was setup for me when I was 6 years old because of the death of my father. My mother was the one to set it up. I am now 22 going on 23 years old. I want to change the way it is setup. Is is possible or not? and please dont say to call jgwentworth or any of those people because they are rippoffs. Ive already looked into it.
